CAAA Early Reduction Program

EPA 33/50 Voluntary Reduction Program

Goals

Reporting requirements: Collect and disseminate information on pollution to all media and provide financial aid to states

For air only, reduction for source by 90% for gaseous hazardous air pollutants (HAPs) and 95% for particulate HAPs; uses hazard index for weighting reductions of highly toxic pollutants

Voluntary reduction of pollutants to all media by 33% by the end of 1992 and by 50% by the end of 1995

Number and Type of Chemicals

All SARA 313 chemicals

All 189 HAPs listed in the CAAAs of which 35 are considered high-risk HAPs

17 chemicals, all of which are listed HAPs

Affected Sources

Facilities with ten or more employees, within standard industrial classification (SIC) 20-39, handling amounts greater than specified threshold limits for reporting

Facility-specific sources emitting more than 10 tn/yr of one HAP or more than 25 tn/yr of combined HAPs; flexible definition of source; credits for other reductions, including regulatory reductions, 33/50 reductions, or production shutdown or curtailment

Any SARA reporting companies; source can be all facilities operated by a company

Reporting Requirements

Annual, via new EPA Form R; report amounts of waste, recycle, and treated materials, amounts treated or disposed onsite and offsite, and treatment methods; project next two years

Six-year extension for implementing MACT; must enter into an enforceable commitment prior to EPA defining MACT in regulations; four submittal requirements: source identification, base-year HAP emissions, reduction plan, and statement of commitment

For production throughput baseline production from prior year

Emissions in 1987 or later

Measured by annual EPA Form R relative to 1988 baseline year

Deadline(s)

7/1/92 for calendar year 1991 and every year thereafter

Achieve early reduction prior to MACT for the source or achieve reduction by 1/1/94 for sources with MACT prior to 1994

End of years 1992 and 1995

Enforcement

Penalties up to $25,000 per day

The company may rescind prior to 12/1/93 without penalty; voluntary but enforceable once committed
